Welcome to MissQ! By visiting our website and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

Please read these Terms of Service carefully before accessing or using our website.

 

1. General Conditions

 

  • Currency: All prices are displayed in New Zealand Dollars (NZD) and include GST (15%) unless otherwise stated.

  • Right to Refuse: We reserve the right to refuse service to anyone for any reason at any time (though we generally try to be nice about it!).

  • Accuracy: We try our best to ensure all information on the site is accurate. However, we are not responsible if information made available on this site is not accurate, complete, or current.

 

2. Products & Colors

 

  • Display: We have made every effort to display the colors and images of our shoes as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be accurate.

  • Availability: All products are subject to availability. We reserve the right to limit the quantities of any products or services that we offer.

  • Modifications: Prices for our products are subject to change without notice.

 

3. Accuracy of Billing & Account Information

 

We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store so that we can complete your transactions and contact you as needed.

 

4. Shipping & Returns

 

Your purchase is subject to our specific policies regarding shipping and returns. By agreeing to these Terms, you also acknowledge you have read and understood:

  • Returns Policy: You understand that "Change of Mind" returns result in Store Credit (not refunds) and that postage is at your cost. You understand that exchanges for size are free of shipping charges. You acknowledge the 14-day return window.

  • Shipping Policy: You understand our cutoff times (2 PM) for same-day dispatch and the specific terms regarding the Auckland Same-Day delivery service ($25 charge).

 

5. New Zealand Consumer Guarantees Act (CGA)

 

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993.

  • If you are acquiring goods for personal, domestic, or household use, you have certain rights and remedies under the Act that cannot be excluded.

  • If you are acquiring goods for business purposes, the provisions of the Consumer Guarantees Act 1993 do not apply.

 

6. Limitation of Liability

 

MissQ shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of any of the service or any products procured using the service, except as required by New Zealand law.

 

7. Intellectual Property

 

All content on this site (images, text, logos, and shoe designs) is the property of MissQ. You may not use our images or text for commercial purposes without our express written permission.

 

8. Governing Law

 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.
